ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) Version 1.0 Effective Date: July 2026 PART 1 – INTRODUCTION, DEFINITIONS AND SCOPE § 1. Introduction Welcome to Action Tours Global LLC. These General Terms and Conditions ("Terms") govern the use of the Action Tours Global LLC website, all online booking services, payment processing and tourism-related activities offered through the Company's booking platform. By accessing our website, creating a booking, making a payment or participating in an activity booked through our platform, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use our services. § 1.1. About Action Tours Global LLC Action Tours Global LLC operates an international online booking platform for tourism and leisure activities. Depending on the individual booking, Action Tours Global LLC may act as: the organizer of an activity; the contractual service provider; the booking platform; the payment collection platform; or an intermediary arranging services provided by independent local operators. The role of Action Tours Global LLC for each booking is indicated on the relevant booking page. Where Action Tours Global LLC acts solely as an intermediary, the operational delivery of the activity remains the responsibility of the respective local service provider. § 1.2. Definitions For the purposes of these Terms: Company means Action Tours Global LLC. Customer means the person making the booking. Participant means every person taking part in the booked activity. Booking means a confirmed reservation completed through the Company's booking platform. Activity means any tourism, rental or leisure service offered through the platform. Local Service Provider means an independent operator responsible for delivering the booked activity. Rental Vehicle means any vehicle or equipment temporarily provided to the Customer, including but not limited to quad bikes, scooters, jet skis, boats, bicycles or similar equipment. Website means all websites, mobile websites, applications and booking systems operated by or on behalf of Action Tours Global LLC. Force Majeure has the meaning assigned in Part 8 of these Terms. § 1.3. Scope of Application These Terms apply to every booking made through the booking platform operated by Action Tours Global LLC unless otherwise agreed in writing. Where additional conditions apply to a specific activity, vehicle or local operator, those conditions shall form part of the booking contract and shall be presented before the booking is completed. If mandatory consumer protection laws provide greater protection than these Terms, the applicable law shall prevail. § 1.4. Eligibility Customers making a booking confirm that they: are at least eighteen (18) years of age or have the consent of a legal guardian where permitted by law; possess the legal capacity to enter into binding contracts; provide complete and accurate booking information; are authorized to use the selected payment method. Action Tours Global LLC reserves the right to refuse or cancel bookings where false information, fraudulent activity or unauthorized payment methods are identified. § 1.5. Contract Formation A booking becomes legally binding only when all of the following conditions have been fulfilled: the requested activity is available; payment has been successfully authorized or received; Action Tours Global LLC has issued a booking confirmation. Until a booking confirmation has been sent, no contract shall be deemed concluded. § 1.6. Customer Responsibilities During Booking Before completing a booking, Customers are responsible for ensuring that: all participant information is correct; the selected activity is suitable for all participants; travel dates and meeting points have been reviewed; contact details are accurate; all special requirements have been communicated before booking where applicable. Customers remain responsible for any losses resulting from incorrect information submitted during the booking process. § 1.7. Electronic Communication The Customer agrees that Action Tours Global LLC may send booking confirmations, invoices, amendments, cancellation notices and other contractual communications electronically. Electronic communications shall be deemed received once transmitted to the email address or contact information provided during booking, unless proven otherwise. § 1.8. Website Availability Action Tours Global LLC uses reasonable efforts to ensure that its website and booking platform remain available at all times. However, temporary interruptions may occur due to: scheduled maintenance; technical failures; internet service interruptions; cyber security measures; third-party service outages; or circumstances beyond the Company's reasonable control. Such interruptions shall not constitute a breach of contract. § 1.9. Accuracy of Information Action Tours Global LLC makes reasonable efforts to ensure that all descriptions, prices, photographs, itineraries and availability information published on its website are accurate. If an obvious error is identified before the activity begins, the Company may correct the information and immediately inform the Customer. Where such correction materially affects the booking, the Customer may either: accept the corrected booking; or cancel the booking and receive a full refund. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 2 – PRICES, PAYMENTS AND BILLING § 2. Prices All prices published on the Action Tours Global LLC website are displayed in the currency specified during the booking process. Prices shown at the time of booking apply exclusively to the selected booking and remain valid once the booking has been confirmed. Action Tours Global LLC reserves the right to modify prices at any time prior to the conclusion of a contract. § 2.1. Taxes and Government Charges Unless expressly stated otherwise, published prices include all taxes and mandatory fees known at the time of booking. Where local legislation requires additional tourism taxes, environmental charges, harbour fees or similar governmental charges that cannot reasonably be collected in advance, such charges shall be clearly indicated before completion of the booking and remain payable by the Customer. § 2.2. Currency For the convenience of international Customers, prices may be displayed in different currencies. Where currency conversion is provided, the displayed exchange rate is for informational purposes only. The final amount charged may vary depending on: the Customer's bank; the card issuer; exchange rate fluctuations; payment provider conversion rates. Action Tours Global LLC is not responsible for differences resulting from currency conversion performed by financial institutions. § 2.3. Accepted Payment Methods Available payment methods are displayed during checkout and may include: Credit Cards Debit Cards Apple Pay Google Pay PayPal Bank Transfer Digital Wallets Other approved payment providers The availability of individual payment methods may vary depending on the Customer's country, applicable regulations or technical availability. § 2.4. Payment Authorization By submitting payment information, the Customer confirms that: they are authorized to use the selected payment method; the payment information is accurate; sufficient funds or credit are available; the transaction is lawful. Action Tours Global LLC reserves the right to refuse payment methods that cannot be successfully authorized. § 2.5. Payment Processing Payments are processed through secure third-party payment service providers. Action Tours Global LLC does not store complete payment card details on its own servers unless required by applicable law or necessary for processing the transaction. Payment processing is subject to the terms and security standards of the respective payment service provider. § 2.6. Failed Payments Where payment cannot be completed due to: insufficient funds; expired payment cards; incorrect payment details; payment authorization failure; technical interruptions; refusal by the payment provider; the requested booking shall not be confirmed. The Company shall not be responsible for any resulting loss of availability. § 2.7. Deposits and Partial Payments For certain activities, Action Tours Global LLC or the local service provider may permit payment of only a deposit at the time of booking. Where a deposit is accepted, the remaining balance shall be payable in accordance with the booking confirmation or directly to the local service provider before commencement of the activity. Failure to pay the remaining balance may result in refusal of participation. § 2.8. Promotional Offers Action Tours Global LLC may occasionally offer: promotional discounts; seasonal campaigns; referral rewards; voucher codes; special offers. Unless expressly stated otherwise: promotions may not be combined; promotions have no cash value; promotions are valid only during the published promotional period. § 2.9. Gift Vouchers Gift vouchers issued by Action Tours Global LLC: may only be redeemed within their stated validity period; cannot be exchanged for cash; may not be resold without prior written authorization; may only be redeemed in accordance with the published voucher conditions. Lost, stolen or fraudulently obtained vouchers may be cancelled without compensation. § 2.10. Invoices Invoices and payment confirmations shall be issued electronically. Customers are responsible for providing accurate billing information at the time of booking. Requests for corrections should be submitted without undue delay after receipt of the booking confirmation. § 2.11. Payment Security Action Tours Global LLC uses commercially reasonable technical and organizational measures to protect payment transactions. Although industry-standard security technologies are used, no internet-based transmission can be guaranteed to be completely secure. Customers are responsible for protecting their own devices, passwords and payment credentials. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 3 – CANCELLATIONS, RESCHEDULING AND REFUNDS § 3. Customer Cancellation Customers may cancel a confirmed booking free of charge up to 24 hours before the scheduled start time of the booked activity. The cancellation becomes effective when it is received through an official communication channel provided by Action Tours Global LLC. Accepted cancellation channels include: the customer booking portal; email: info@action-tours.online the official website contact form; or any other communication method officially designated by Action Tours Global LLC. § 3.1. Cancellation Charges Unless otherwise stated on the individual activity page, the following cancellation policy applies: More than 24 hours before the scheduled activity Full refund of the amount paid. 24 hours or less before the scheduled activity No refund. After the activity has commenced No refund. § 3.2. Rescheduling Customers may request one free rescheduling of their booking provided that: the request is received more than 24 hours before the scheduled activity; and the requested alternative date is available. Additional rescheduling requests or requests submitted within 24 hours of the activity may be refused or may be subject to an administrative fee where permitted by law. § 3.3. No-Show A No-Show occurs when a Customer fails to appear at the agreed meeting point by the scheduled departure time without having cancelled the booking in accordance with Section 3. No-Shows are not eligible for any refund. § 3.4. Late Arrival Customers are responsible for arriving at the designated meeting point at least 15 minutes before the scheduled starting time unless another arrival time is stated in the booking confirmation. Late arrival may prevent participation where operational or safety reasons require the activity to depart on time. Late arrival does not create any entitlement to a refund. § 3.5. Flight Delays and Travel Disruptions Customers are responsible for allowing sufficient travel time. Missed activities caused by: flight delays; cancelled flights; ferry delays; traffic congestion; public transport interruptions; visa issues; or passport problems do not automatically entitle the Customer to a refund. Where operationally possible, Action Tours Global LLC may, at its sole discretion, offer an alternative date. § 3.6. Illness and Personal Emergencies Illness, injury or personal emergencies do not automatically create a right to a refund for cancellations made less than 24 hours before the scheduled activity. Customers are encouraged to obtain appropriate travel cancellation insurance. Where operationally possible, Action Tours Global LLC may offer a rescheduling option as a gesture of goodwill. § 3.7. Cancellation by Action Tours Global LLC Action Tours Global LLC or the relevant Local Service Provider may cancel an activity where this is necessary due to: unsafe operating conditions; severe weather; mechanical failure; government restrictions; safety concerns; operational emergencies; or failure to reach the required minimum number of participants. In such cases, the Customer may choose between: a full refund; or rescheduling to another available date. Where both parties agree, an alternative activity of equal or greater value may also be offered. § 3.8. Minimum Participant Requirement Certain activities require a minimum number of participants. If the required minimum number is not reached, the activity may be cancelled. Customers shall be informed as early as reasonably possible and may choose between: a full refund; or rescheduling. § 3.9. Refund Procedure Approved refunds shall normally be processed using the original payment method. Refund processing times depend on the Customer's financial institution and payment provider. Refunds are generally completed within 5 to 14 business days, although longer processing times may occur depending on the payment provider. § 3.10. Partial Refunds Where only part of a booked service cannot be provided, Action Tours Global LLC may issue a proportional refund corresponding to the value of the affected service. § 3.11. Activities Already Commenced Once an activity has commenced, no refund shall be payable where the Customer voluntarily withdraws from participation. This includes withdrawal due to: personal preference; fatigue; fear; discomfort; or any other reason not attributable to Action Tours Global LLC or the Local Service Provider. § 3.12. Travel Documents Customers are solely responsible for ensuring that they possess all documents required to participate in the booked activity, including where applicable: passports; visas; valid driver's licences; identification documents; and any permits required under local law. Failure to present required documentation at the start of the activity shall not create a right to a refund. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 4 – PARTICIPATION REQUIREMENTS, SAFETY AND CUSTOMER CONDUCT § 4. General Participation Requirements Participation in any activity offered through the Action Tours Global LLC booking platform is voluntary. By participating, the Customer confirms that they understand the nature of the booked activity and agree to comply with all safety instructions issued by Action Tours Global LLC or the Local Service Provider. § 4.1. Minimum Age Requirements Participation may be subject to minimum age requirements determined by the nature of the activity or applicable local law. Where required, proof of age may be requested before the activity begins. Minors may only participate under the conditions specified for the respective activity and, where applicable, with the consent or supervision of a parent or legal guardian. § 4.2. Physical and Mental Fitness Customers are responsible for ensuring that they are physically and mentally capable of safely participating in the booked activity. Customers should not participate if they suffer from any medical condition that may place themselves or others at risk. Where appropriate, Customers are advised to seek medical advice before booking. § 4.3. Pregnancy Certain activities may not be suitable during pregnancy. For safety reasons, participation may be refused where the Local Service Provider reasonably considers the activity to present an unacceptable risk to the participant or the unborn child. § 4.4. Alcohol and Drugs Participation while under the influence of alcohol, illegal drugs or medication that may impair judgement, coordination or reaction time is strictly prohibited. Where there is a reasonable belief that a Customer is impaired, participation may be refused in the interest of safety. § 4.5. Safety Equipment Customers shall correctly use all mandatory safety equipment provided for the activity. Safety equipment may include, but is not limited to: helmets; life jackets; protective clothing; gloves; safety harnesses; eye protection. Customers may not remove or misuse required safety equipment during the activity. § 4.6. Safety Briefing Where a safety briefing is provided before the activity, attendance is mandatory. Customers are responsible for informing the guide or instructor if they do not understand any safety instruction. Failure to attend or deliberately disregard the safety briefing may result in exclusion from the activity. § 4.7. Compliance with Guide Instructions Customers shall comply with all lawful instructions given by guides, instructors and authorized representatives during the activity. Operational decisions made for safety reasons are final and must be respected. § 4.8. Customer Conduct Customers shall behave in a respectful and responsible manner throughout the activity. The following behaviour is prohibited: aggressive behaviour; threatening or abusive language; discrimination or harassment; intentional damage to property; reckless conduct that endangers other participants; deliberate disregard of safety instructions. § 4.9. Respect for Local Laws and Culture Customers shall respect: applicable laws; local customs; cultural traditions; religious sites; private property. Any legal consequences resulting from violations shall remain the sole responsibility of the Customer. § 4.10. Environmental Protection Customers shall act responsibly towards the environment and shall not: litter; intentionally damage vegetation; disturb wildlife; pollute beaches, parks or protected areas. Any penalties imposed by public authorities due to the Customer's conduct shall be borne by the Customer. § 4.11. Animal Welfare Activities involving animals shall be conducted with respect for animal welfare. Customers shall follow all instructions concerning the treatment of animals and shall not engage in any conduct likely to cause unnecessary stress, injury or suffering. The Local Service Provider may immediately end the Customer's participation if animal welfare is endangered. § 4.12. Clothing and Personal Equipment Customers are responsible for wearing suitable clothing and footwear appropriate for the booked activity and weather conditions. Action Tours Global LLC shall not be responsible for discomfort, inconvenience or inability to participate resulting from inappropriate clothing or equipment chosen by the Customer. § 4.13. Right to Refuse Participation Action Tours Global LLC or the Local Service Provider may refuse participation where a Customer: fails to satisfy the participation requirements; appears to be under the influence of alcohol or drugs; refuses to follow safety instructions; behaves aggressively or irresponsibly; presents a danger to themselves or others. Such decisions shall be made solely for safety reasons. § 4.14. Removal from an Activity A Customer who seriously breaches these Terms or whose conduct endangers the safety, wellbeing or enjoyment of others may be removed from the activity. Removal from an activity shall not entitle the Customer to any refund or compensation. § 4.15. Acceptance of Participation Requirements By participating in an activity booked through Action Tours Global LLC, the Customer confirms that they have read, understood and accepted the participation and safety requirements set out in this Part. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 5 – RENTAL VEHICLES AND EQUIPMENT § 5. Scope This Part applies to all bookings involving the temporary rental or use of vehicles or recreational equipment offered through Action Tours Global LLC or one of its Local Service Providers. This includes, but is not limited to: Quad Bikes (ATVs) Scooters Motorcycles Jet Skis Buggies Boats Bicycles E-Bikes Kayaks Paddle Boards Other recreational vehicles or equipment. § 5.1. Inspection and Handover Before the rental begins, the Customer shall inspect the vehicle or equipment together with the Local Service Provider where reasonably possible. Visible defects or damage should be reported before the activity starts. Unless documented otherwise, the vehicle or equipment shall be deemed to have been accepted in good condition. § 5.2. Driver Qualifications Where operation of a vehicle requires a valid driving licence or other legal authorization, the Customer shall present the required documentation before the rental begins. The Customer is solely responsible for ensuring that their licence is valid for the vehicle category and recognised under applicable local law. § 5.3. Authorized Users Only the Customer or other persons expressly authorised by the Local Service Provider may operate the rented vehicle or equipment. The Customer shall not permit any unauthorized person to use the rented vehicle or equipment. § 5.4. Proper Use The rented vehicle or equipment shall only be used: for its intended purpose; in accordance with the manufacturer's recommendations where applicable; in accordance with local laws; in accordance with the instructions of the Local Service Provider. § 5.5. Restricted Use Unless expressly authorised by the Local Service Provider, the Customer shall not: participate in races or competitions; tow another vehicle; use the vehicle for commercial purposes; operate the vehicle outside designated operating areas; overload the vehicle beyond its permitted capacity; intentionally misuse the vehicle. § 5.6. Fuel and Charging Where applicable, the Customer shall return the vehicle with substantially the same fuel or battery level as provided at handover, unless different arrangements have been agreed in advance. § 5.7. Mechanical Problems If the Customer notices any mechanical defect or technical malfunction during the rental period, operation of the vehicle shall cease immediately where continued use may create a safety risk. The Local Service Provider shall be informed without undue delay. Customers shall not carry out repairs unless expressly authorised to do so. § 5.8. Accidents In the event of an accident involving a rented vehicle or equipment, the Customer shall: stop immediately where safe to do so; comply with applicable legal requirements; notify the Local Service Provider without undue delay; cooperate in the preparation of any accident report where required. § 5.9. Theft or Loss The Customer shall take reasonable precautions to protect the rented vehicle or equipment against theft or loss. Any theft or loss shall be reported immediately to the Local Service Provider and, where required by law, to the competent authorities. § 5.10. Traffic and Administrative Offences The Customer shall remain solely responsible for: traffic fines; parking penalties; toll violations; navigation offences; administrative penalties; incurred during the rental period. § 5.11. Operating Areas Vehicles or equipment may only be used within the operating areas approved by the Local Service Provider. Access to protected areas, private property or restricted zones is prohibited unless expressly permitted. § 5.12. Return of Vehicles and Equipment Vehicles and equipment shall be returned: at the agreed location; at the agreed time; and together with all accessories provided. Late returns may result in additional rental charges where such charges have been disclosed before the booking. § 5.13. Cleaning Customers are expected to return rented vehicles and equipment in a reasonably clean condition, taking into account the normal nature of the booked activity. Additional cleaning costs may only be charged where the vehicle or equipment has been returned in an unusually dirty condition beyond normal use. § 5.14. Refusal of Vehicle Handover The Local Service Provider may refuse to hand over a vehicle where the Customer: fails to present the legally required documentation; refuses mandatory operational instructions; is unable to safely operate the vehicle; otherwise fails to satisfy the participation requirements applicable to the rental. Such refusal shall be based solely on legal or safety considerations. § 5.15 Return Inspection Upon return, the Local Service Provider may inspect the vehicle or equipment. Any newly identified damage may be documented using reasonable evidence, including photographs, videos or written inspection reports. The Customer shall be informed of any documented damage within a reasonable period. § 5.16. Additional Rental Conditions Certain vehicles or equipment may be subject to additional rental conditions issued by the respective Local Service Provider. Where such additional conditions apply, they shall be clearly communicated before completion of the booking and shall form part of the rental agreement. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 6 – LIABILITY AND INSURANCE § 6. General Liability Action Tours Global LLC shall be liable only in accordance with these Terms and the mandatory provisions of applicable law. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by law. § 6.1. Liability of Action Tours Global LLC Where Action Tours Global LLC acts as the organiser of an activity, the Company shall be responsible for the proper performance of its contractual obligations. Where Action Tours Global LLC acts solely as an intermediary or booking platform, responsibility for the operation and execution of the booked activity remains with the respective Local Service Provider. § 6.2. Liability of Local Service Providers Each Local Service Provider is independently responsible for: conducting the booked activity; maintaining vehicles and equipment; providing qualified guides or instructors where applicable; complying with local laws and regulations; implementing appropriate safety procedures. Action Tours Global LLC shall not be liable for operational decisions or omissions of an independent Local Service Provider except where liability is imposed by mandatory law. § 6.3. Limitation of Liability To the fullest extent permitted by applicable law, Action Tours Global LLC shall only be liable for direct losses resulting from its own intentional misconduct or gross negligence. The Company shall not be liable for indirect or consequential damages, including but not limited to: loss of profits; loss of business opportunities; loss of enjoyment; travel interruptions; accommodation costs; missed connections; or other consequential financial losses. This limitation does not apply where liability cannot legally be excluded. § 6.4. Customer Liability Customers are responsible for any damage they intentionally or negligently cause to: persons; vehicles; equipment; buildings; property; animals; or other participants, to the extent permitted by applicable law. § 6.5. Duty to Mitigate Loss Customers shall take reasonable steps to minimise any damage or loss arising during the performance of the booked activity. Failure to take reasonable measures may be taken into account when assessing any claim, where permitted by applicable law. § 6.6. Insurance Unless expressly stated otherwise, the booking price does not include: travel insurance; medical insurance; accident insurance; cancellation insurance; personal liability insurance. Customers are strongly encouraged to obtain appropriate insurance before travelling. Where a Local Service Provider includes insurance for a specific activity or rental vehicle, the scope, exclusions and limitations of that insurance shall be determined solely by the terms of the respective insurance policy or Local Service Provider. § 6.7. Medical Expenses Unless required by applicable law, Customers are solely responsible for all medical expenses arising from illness, injury or accidents occurring before, during or after the booked activity. § 6.8. Customer Claims If a Customer believes that a booked service has not been provided in accordance with the booking confirmation, the Customer should notify Action Tours Global LLC or the Local Service Provider as soon as reasonably possible. Prompt notification enables the issue to be investigated and, where appropriate, resolved without unnecessary delay. § 6.9. Time Limit for Complaints Unless a longer period is required by mandatory law, complaints relating to a booked activity should be submitted in writing within 30 days after the scheduled activity date. This provision does not affect any statutory limitation periods applicable under mandatory law. § 6.10. Customer Indemnification To the extent permitted by applicable law, Customers agree to indemnify and hold harmless Action Tours Global LLC, its directors, officers, employees and authorised representatives against claims arising directly from: breach of these Terms; unlawful conduct; misuse of rented vehicles or equipment; violation of applicable laws; or intentional damage caused by the Customer. § 6.11. Survival of Liability Provisions The provisions of this Part relating to liability, indemnification and limitation of liability shall survive the completion, cancellation or termination of the booking to the extent permitted by applicable law. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 7 – PRIVACY, MEDIA, INTELLECTUAL PROPERTY AND CUSTOMER CONTENT § 7. Privacy Action Tours Global LLC processes personal data solely for the purpose of providing its booking services, processing payments, communicating with Customers and complying with applicable legal obligations. Personal data shall be processed in accordance with the Company's Privacy Policy and applicable data protection laws. § 7.1 Customer Information Customers are responsible for ensuring that all personal information provided during the booking process is complete, accurate and kept up to date where necessary. Action Tours Global LLC shall not be responsible for losses resulting from incorrect or outdated information provided by the Customer. § 7.2. Electronic Records Customers acknowledge that booking confirmations, invoices, payment confirmations and other contractual records may be stored electronically. Electronic records may be retained for the period required by applicable law or for the legitimate business purposes of Action Tours Global LLC. § 7.3. Photography and Video Recording During certain activities, photographs or video recordings may be taken by Action Tours Global LLC or the Local Service Provider for operational, safety or promotional purposes. Where required by applicable law, the Customer's consent shall be obtained before photographs or videos are used for advertising or marketing purposes. Customers who do not wish to appear in promotional material should inform the guide or Local Service Provider before the activity begins. § 7.4. Customer Photography Customers may take photographs and videos for personal, non-commercial use during an activity unless: prohibited by law; restricted for safety reasons; restricted by the Local Service Provider; or prohibited in order to protect the privacy of other participants. The commercial use of photographs or videos taken during an activity requires prior written permission from the respective rights holder. § 7.5. Use of Drones The operation of drones during an activity is only permitted where: local law permits such operation; all required authorisations have been obtained; and the Local Service Provider has granted prior approval. Customers remain solely responsible for complying with all aviation and privacy regulations. § 7.6. Customer Reviews Customers are welcome to submit honest reviews based on their personal experience. Reviews should: be truthful; relate to the booked activity; not contain unlawful, offensive or defamatory content; not infringe the rights of third parties. Action Tours Global LLC reserves the right to report or request the removal of reviews that violate applicable law or the terms of the respective review platform. § 7.8. Customer Content Where Customers upload photographs, videos, comments or other content through the Company's website or social media channels, they confirm that: they own the necessary rights to such content; or they have obtained all necessary permissions. Customers remain responsible for all content they submit. § 7.9. Marketing Communications Customers may receive service-related communications necessary for the performance of their booking. Marketing communications shall only be sent where permitted by applicable law or where the Customer has provided the required consent. Customers may withdraw their consent to receive marketing communications at any time using the unsubscribe method provided or by contacting Action Tours Global LLC. § 7.10. Website Use Customers shall not: attempt to gain unauthorized access to the Company's systems; interfere with the operation of the website; introduce malicious software; misuse the booking platform; use automated systems to extract website content without authorization. Action Tours Global LLC reserves all rights available under applicable law against unauthorized use of its systems. § 7.11. Reservation of Rights All rights not expressly granted to Customers under these Terms remain reserved by Action Tours Global LLC and the respective intellectual property owners. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 8 – FINAL PROVISIONS § 8. Force Majeure Neither Action Tours Global LLC nor the Local Service Provider shall be liable for any delay, interruption or failure to perform contractual obligations where such performance is prevented or substantially hindered by events beyond their reasonable control. Force Majeure includes, but is not limited to: natural disasters; floods; earthquakes; hurricanes; severe storms; sandstorms; fires; pandemics; epidemics; war; terrorism; civil unrest; government actions; border closures; airport closures; transportation disruptions; strikes; cyberattacks; widespread power failures; or any other unforeseeable event beyond reasonable control. Where reasonably possible, Action Tours Global LLC shall make reasonable efforts to offer an alternative date, an alternative activity or another mutually acceptable solution. Nothing in this Section shall affect any mandatory consumer rights applicable under law. § 8.1. Changes to these Terms Action Tours Global LLC reserves the right to amend these Terms where necessary due to: legal requirements; operational changes; technological developments; business requirements. Any amendments shall apply only to bookings made after the revised Terms have been published. Confirmed bookings remain subject to the Terms accepted at the time of booking unless mandatory law requires otherwise. § 8.2. Invalid Provisions (Severability) If any provision of these Terms is found to be invalid, illegal or unenforceable under applicable law, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law. The invalid provision shall, where possible, be replaced by a valid provision that most closely reflects the original commercial intention. § 8.3. Waiver Failure by Action Tours Global LLC to enforce any provision of these Terms on one occasion shall not constitute a waiver of the right to enforce that provision or any other provision in the future. § 8.4. Entire Agreement These Terms, together with: the booking confirmation; the applicable activity description; any additional conditions communicated before booking; and the Privacy Policy, constitute the entire agreement between the Customer and Action Tours Global LLC relating to the booked service. § 8.5. Governing Law These Terms shall be governed by the laws of the State of Wyoming, United States of America, unless mandatory consumer protection laws applicable to the Customer require otherwise. § 8.6. Dispute Resolution Before commencing legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through direct communication and good-faith negotiations. Customers are encouraged to contact Action Tours Global LLC promptly so that concerns may be investigated and, where appropriate, resolved without unnecessary legal proceedings. Nothing in this Section limits any rights that cannot legally be waived under applicable law. § 8.7. Jurisdiction Unless mandatory law provides otherwise, the courts having jurisdiction in the State of Wyoming, United States of America, shall have exclusive jurisdiction over disputes arising from these Terms. Where mandatory consumer protection laws grant Customers the right to bring proceedings before another competent court, such rights shall remain unaffected. § 8.8. Language These General Terms and Conditions have been prepared in the English language. Translations into other languages are provided solely for the convenience of Customers. In the event of any inconsistency or conflict between a translated version and the English version, the English version shall prevail, unless mandatory law requires otherwise. § 8.9. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) Version 1.0 Effective Date: July 2026 PART 1 – INTRODUCTION, DEFINITIONS AND SCOPE § 1. Introduction Welcome to Action Tours Global LLC. These General Terms and Conditions ("Terms") govern the use of the Action Tours Global LLC website, all online booking services, payment processing and tourism-related activities offered through the Company's booking platform. By accessing our website, creating a booking, making a payment or participating in an activity booked through our platform, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use our services. § 1.1. About Action Tours Global LLC Action Tours Global LLC operates an international online booking platform for tourism and leisure activities. Depending on the individual booking, Action Tours Global LLC may act as: the organizer of an activity; the contractual service provider; the booking platform; the payment collection platform; or an intermediary arranging services provided by independent local operators. The role of Action Tours Global LLC for each booking is indicated on the relevant booking page. Where Action Tours Global LLC acts solely as an intermediary, the operational delivery of the activity remains the responsibility of the respective local service provider. § 1.2. Definitions For the purposes of these Terms: Company means Action Tours Global LLC. Customer means the person making the booking. Participant means every person taking part in the booked activity. Booking means a confirmed reservation completed through the Company's booking platform. Activity means any tourism, rental or leisure service offered through the platform. Local Service Provider means an independent operator responsible for delivering the booked activity. Rental Vehicle means any vehicle or equipment temporarily provided to the Customer, including but not limited to quad bikes, scooters, jet skis, boats, bicycles or similar equipment. Website means all websites, mobile websites, applications and booking systems operated by or on behalf of Action Tours Global LLC. Force Majeure has the meaning assigned in Part 8 of these Terms. § 1.3. Scope of Application These Terms apply to every booking made through the booking platform operated by Action Tours Global LLC unless otherwise agreed in writing. Where additional conditions apply to a specific activity, vehicle or local operator, those conditions shall form part of the booking contract and shall be presented before the booking is completed. If mandatory consumer protection laws provide greater protection than these Terms, the applicable law shall prevail. § 1.4. Eligibility Customers making a booking confirm that they: are at least eighteen (18) years of age or have the consent of a legal guardian where permitted by law; possess the legal capacity to enter into binding contracts; provide complete and accurate booking information; are authorized to use the selected payment method. Action Tours Global LLC reserves the right to refuse or cancel bookings where false information, fraudulent activity or unauthorized payment methods are identified. § 1.5. Contract Formation A booking becomes legally binding only when all of the following conditions have been fulfilled: the requested activity is available; payment has been successfully authorized or received; Action Tours Global LLC has issued a booking confirmation. Until a booking confirmation has been sent, no contract shall be deemed concluded. § 1.6. Customer Responsibilities During Booking Before completing a booking, Customers are responsible for ensuring that: all participant information is correct; the selected activity is suitable for all participants; travel dates and meeting points have been reviewed; contact details are accurate; all special requirements have been communicated before booking where applicable. Customers remain responsible for any losses resulting from incorrect information submitted during the booking process. § 1.7. Electronic Communication The Customer agrees that Action Tours Global LLC may send booking confirmations, invoices, amendments, cancellation notices and other contractual communications electronically. Electronic communications shall be deemed received once transmitted to the email address or contact information provided during booking, unless proven otherwise. § 1.8. Website Availability Action Tours Global LLC uses reasonable efforts to ensure that its website and booking platform remain available at all times. However, temporary interruptions may occur due to: scheduled maintenance; technical failures; internet service interruptions; cyber security measures; third-party service outages; or circumstances beyond the Company's reasonable control. Such interruptions shall not constitute a breach of contract. § 1.9. Accuracy of Information Action Tours Global LLC makes reasonable efforts to ensure that all descriptions, prices, photographs, itineraries and availability information published on its website are accurate. If an obvious error is identified before the activity begins, the Company may correct the information and immediately inform the Customer. Where such correction materially affects the booking, the Customer may either: accept the corrected booking; or cancel the booking and receive a full refund. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 2 – PRICES, PAYMENTS AND BILLING § 2. Prices All prices published on the Action Tours Global LLC website are displayed in the currency specified during the booking process. Prices shown at the time of booking apply exclusively to the selected booking and remain valid once the booking has been confirmed. Action Tours Global LLC reserves the right to modify prices at any time prior to the conclusion of a contract. § 2.1. Taxes and Government Charges Unless expressly stated otherwise, published prices include all taxes and mandatory fees known at the time of booking. Where local legislation requires additional tourism taxes, environmental charges, harbour fees or similar governmental charges that cannot reasonably be collected in advance, such charges shall be clearly indicated before completion of the booking and remain payable by the Customer. § 2.2. Currency For the convenience of international Customers, prices may be displayed in different currencies. Where currency conversion is provided, the displayed exchange rate is for informational purposes only. The final amount charged may vary depending on: the Customer's bank; the card issuer; exchange rate fluctuations; payment provider conversion rates. Action Tours Global LLC is not responsible for differences resulting from currency conversion performed by financial institutions. § 2.3. Accepted Payment Methods Available payment methods are displayed during checkout and may include: Credit Cards Debit Cards Apple Pay Google Pay PayPal Bank Transfer Digital Wallets Other approved payment providers The availability of individual payment methods may vary depending on the Customer's country, applicable regulations or technical availability. § 2.4. Payment Authorization By submitting payment information, the Customer confirms that: they are authorized to use the selected payment method; the payment information is accurate; sufficient funds or credit are available; the transaction is lawful. Action Tours Global LLC reserves the right to refuse payment methods that cannot be successfully authorized. § 2.5. Payment Processing Payments are processed through secure third-party payment service providers. Action Tours Global LLC does not store complete payment card details on its own servers unless required by applicable law or necessary for processing the transaction. Payment processing is subject to the terms and security standards of the respective payment service provider. § 2.6. Failed Payments Where payment cannot be completed due to: insufficient funds; expired payment cards; incorrect payment details; payment authorization failure; technical interruptions; refusal by the payment provider; the requested booking shall not be confirmed. The Company shall not be responsible for any resulting loss of availability. § 2.7. Deposits and Partial Payments For certain activities, Action Tours Global LLC or the local service provider may permit payment of only a deposit at the time of booking. Where a deposit is accepted, the remaining balance shall be payable in accordance with the booking confirmation or directly to the local service provider before commencement of the activity. Failure to pay the remaining balance may result in refusal of participation. § 2.8. Promotional Offers Action Tours Global LLC may occasionally offer: promotional discounts; seasonal campaigns; referral rewards; voucher codes; special offers. Unless expressly stated otherwise: promotions may not be combined; promotions have no cash value; promotions are valid only during the published promotional period. § 2.9. Gift Vouchers Gift vouchers issued by Action Tours Global LLC: may only be redeemed within their stated validity period; cannot be exchanged for cash; may not be resold without prior written authorization; may only be redeemed in accordance with the published voucher conditions. Lost, stolen or fraudulently obtained vouchers may be cancelled without compensation. § 2.10. Invoices Invoices and payment confirmations shall be issued electronically. Customers are responsible for providing accurate billing information at the time of booking. Requests for corrections should be submitted without undue delay after receipt of the booking confirmation. § 2.11. Payment Security Action Tours Global LLC uses commercially reasonable technical and organizational measures to protect payment transactions. Although industry-standard security technologies are used, no internet-based transmission can be guaranteed to be completely secure. Customers are responsible for protecting their own devices, passwords and payment credentials. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 3 – CANCELLATIONS, RESCHEDULING AND REFUNDS § 3. Customer Cancellation Customers may cancel a confirmed booking free of charge up to 24 hours before the scheduled start time of the booked activity. The cancellation becomes effective when it is received through an official communication channel provided by Action Tours Global LLC. Accepted cancellation channels include: the customer booking portal; email: info@action-tours.online the official website contact form; or any other communication method officially designated by Action Tours Global LLC. § 3.1. Cancellation Charges Unless otherwise stated on the individual activity page, the following cancellation policy applies: More than 24 hours before the scheduled activity Full refund of the amount paid. 24 hours or less before the scheduled activity No refund. After the activity has commenced No refund. § 3.2. Rescheduling Customers may request one free rescheduling of their booking provided that: the request is received more than 24 hours before the scheduled activity; and the requested alternative date is available. Additional rescheduling requests or requests submitted within 24 hours of the activity may be refused or may be subject to an administrative fee where permitted by law. § 3.3. No-Show A No-Show occurs when a Customer fails to appear at the agreed meeting point by the scheduled departure time without having cancelled the booking in accordance with Section 3. No-Shows are not eligible for any refund. § 3.4. Late Arrival Customers are responsible for arriving at the designated meeting point at least 15 minutes before the scheduled starting time unless another arrival time is stated in the booking confirmation. Late arrival may prevent participation where operational or safety reasons require the activity to depart on time. Late arrival does not create any entitlement to a refund. § 3.5. Flight Delays and Travel Disruptions Customers are responsible for allowing sufficient travel time. Missed activities caused by: flight delays; cancelled flights; ferry delays; traffic congestion; public transport interruptions; visa issues; or passport problems do not automatically entitle the Customer to a refund. Where operationally possible, Action Tours Global LLC may, at its sole discretion, offer an alternative date. § 3.6. Illness and Personal Emergencies Illness, injury or personal emergencies do not automatically create a right to a refund for cancellations made less than 24 hours before the scheduled activity. Customers are encouraged to obtain appropriate travel cancellation insurance. Where operationally possible, Action Tours Global LLC may offer a rescheduling option as a gesture of goodwill. § 3.7. Cancellation by Action Tours Global LLC Action Tours Global LLC or the relevant Local Service Provider may cancel an activity where this is necessary due to: unsafe operating conditions; severe weather; mechanical failure; government restrictions; safety concerns; operational emergencies; or failure to reach the required minimum number of participants. In such cases, the Customer may choose between: a full refund; or rescheduling to another available date. Where both parties agree, an alternative activity of equal or greater value may also be offered. § 3.8. Minimum Participant Requirement Certain activities require a minimum number of participants. If the required minimum number is not reached, the activity may be cancelled. Customers shall be informed as early as reasonably possible and may choose between: a full refund; or rescheduling. § 3.9. Refund Procedure Approved refunds shall normally be processed using the original payment method. Refund processing times depend on the Customer's financial institution and payment provider. Refunds are generally completed within 5 to 14 business days, although longer processing times may occur depending on the payment provider. § 3.10. Partial Refunds Where only part of a booked service cannot be provided, Action Tours Global LLC may issue a proportional refund corresponding to the value of the affected service. § 3.11. Activities Already Commenced Once an activity has commenced, no refund shall be payable where the Customer voluntarily withdraws from participation. This includes withdrawal due to: personal preference; fatigue; fear; discomfort; or any other reason not attributable to Action Tours Global LLC or the Local Service Provider. § 3.12. Travel Documents Customers are solely responsible for ensuring that they possess all documents required to participate in the booked activity, including where applicable: passports; visas; valid driver's licences; identification documents; and any permits required under local law. Failure to present required documentation at the start of the activity shall not create a right to a refund. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 4 – PARTICIPATION REQUIREMENTS, SAFETY AND CUSTOMER CONDUCT § 4. General Participation Requirements Participation in any activity offered through the Action Tours Global LLC booking platform is voluntary. By participating, the Customer confirms that they understand the nature of the booked activity and agree to comply with all safety instructions issued by Action Tours Global LLC or the Local Service Provider. § 4.1. Minimum Age Requirements Participation may be subject to minimum age requirements determined by the nature of the activity or applicable local law. Where required, proof of age may be requested before the activity begins. Minors may only participate under the conditions specified for the respective activity and, where applicable, with the consent or supervision of a parent or legal guardian. § 4.2. Physical and Mental Fitness Customers are responsible for ensuring that they are physically and mentally capable of safely participating in the booked activity. Customers should not participate if they suffer from any medical condition that may place themselves or others at risk. Where appropriate, Customers are advised to seek medical advice before booking. § 4.3. Pregnancy Certain activities may not be suitable during pregnancy. For safety reasons, participation may be refused where the Local Service Provider reasonably considers the activity to present an unacceptable risk to the participant or the unborn child. § 4.4. Alcohol and Drugs Participation while under the influence of alcohol, illegal drugs or medication that may impair judgement, coordination or reaction time is strictly prohibited. Where there is a reasonable belief that a Customer is impaired, participation may be refused in the interest of safety. § 4.5. Safety Equipment Customers shall correctly use all mandatory safety equipment provided for the activity. Safety equipment may include, but is not limited to: helmets; life jackets; protective clothing; gloves; safety harnesses; eye protection. Customers may not remove or misuse required safety equipment during the activity. § 4.6. Safety Briefing Where a safety briefing is provided before the activity, attendance is mandatory. Customers are responsible for informing the guide or instructor if they do not understand any safety instruction. Failure to attend or deliberately disregard the safety briefing may result in exclusion from the activity. § 4.7. Compliance with Guide Instructions Customers shall comply with all lawful instructions given by guides, instructors and authorized representatives during the activity. Operational decisions made for safety reasons are final and must be respected. § 4.8. Customer Conduct Customers shall behave in a respectful and responsible manner throughout the activity. The following behaviour is prohibited: aggressive behaviour; threatening or abusive language; discrimination or harassment; intentional damage to property; reckless conduct that endangers other participants; deliberate disregard of safety instructions. § 4.9. Respect for Local Laws and Culture Customers shall respect: applicable laws; local customs; cultural traditions; religious sites; private property. Any legal consequences resulting from violations shall remain the sole responsibility of the Customer. § 4.10. Environmental Protection Customers shall act responsibly towards the environment and shall not: litter; intentionally damage vegetation; disturb wildlife; pollute beaches, parks or protected areas. Any penalties imposed by public authorities due to the Customer's conduct shall be borne by the Customer. § 4.11. Animal Welfare Activities involving animals shall be conducted with respect for animal welfare. Customers shall follow all instructions concerning the treatment of animals and shall not engage in any conduct likely to cause unnecessary stress, injury or suffering. The Local Service Provider may immediately end the Customer's participation if animal welfare is endangered. § 4.12. Clothing and Personal Equipment Customers are responsible for wearing suitable clothing and footwear appropriate for the booked activity and weather conditions. Action Tours Global LLC shall not be responsible for discomfort, inconvenience or inability to participate resulting from inappropriate clothing or equipment chosen by the Customer. § 4.13. Right to Refuse Participation Action Tours Global LLC or the Local Service Provider may refuse participation where a Customer: fails to satisfy the participation requirements; appears to be under the influence of alcohol or drugs; refuses to follow safety instructions; behaves aggressively or irresponsibly; presents a danger to themselves or others. Such decisions shall be made solely for safety reasons. § 4.14. Removal from an Activity A Customer who seriously breaches these Terms or whose conduct endangers the safety, wellbeing or enjoyment of others may be removed from the activity. Removal from an activity shall not entitle the Customer to any refund or compensation. § 4.15. Acceptance of Participation Requirements By participating in an activity booked through Action Tours Global LLC, the Customer confirms that they have read, understood and accepted the participation and safety requirements set out in this Part. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 5 – RENTAL VEHICLES AND EQUIPMENT § 5. Scope This Part applies to all bookings involving the temporary rental or use of vehicles or recreational equipment offered through Action Tours Global LLC or one of its Local Service Providers. This includes, but is not limited to: Quad Bikes (ATVs) Scooters Motorcycles Jet Skis Buggies Boats Bicycles E-Bikes Kayaks Paddle Boards Other recreational vehicles or equipment. § 5.1. Inspection and Handover Before the rental begins, the Customer shall inspect the vehicle or equipment together with the Local Service Provider where reasonably possible. Visible defects or damage should be reported before the activity starts. Unless documented otherwise, the vehicle or equipment shall be deemed to have been accepted in good condition. § 5.2. Driver Qualifications Where operation of a vehicle requires a valid driving licence or other legal authorization, the Customer shall present the required documentation before the rental begins. The Customer is solely responsible for ensuring that their licence is valid for the vehicle category and recognised under applicable local law. § 5.3. Authorized Users Only the Customer or other persons expressly authorised by the Local Service Provider may operate the rented vehicle or equipment. The Customer shall not permit any unauthorized person to use the rented vehicle or equipment. § 5.4. Proper Use The rented vehicle or equipment shall only be used: for its intended purpose; in accordance with the manufacturer's recommendations where applicable; in accordance with local laws; in accordance with the instructions of the Local Service Provider. § 5.5. Restricted Use Unless expressly authorised by the Local Service Provider, the Customer shall not: participate in races or competitions; tow another vehicle; use the vehicle for commercial purposes; operate the vehicle outside designated operating areas; overload the vehicle beyond its permitted capacity; intentionally misuse the vehicle. § 5.6. Fuel and Charging Where applicable, the Customer shall return the vehicle with substantially the same fuel or battery level as provided at handover, unless different arrangements have been agreed in advance. § 5.7. Mechanical Problems If the Customer notices any mechanical defect or technical malfunction during the rental period, operation of the vehicle shall cease immediately where continued use may create a safety risk. The Local Service Provider shall be informed without undue delay. Customers shall not carry out repairs unless expressly authorised to do so. § 5.8. Accidents In the event of an accident involving a rented vehicle or equipment, the Customer shall: stop immediately where safe to do so; comply with applicable legal requirements; notify the Local Service Provider without undue delay; cooperate in the preparation of any accident report where required. § 5.9. Theft or Loss The Customer shall take reasonable precautions to protect the rented vehicle or equipment against theft or loss. Any theft or loss shall be reported immediately to the Local Service Provider and, where required by law, to the competent authorities. § 5.10. Traffic and Administrative Offences The Customer shall remain solely responsible for: traffic fines; parking penalties; toll violations; navigation offences; administrative penalties; incurred during the rental period. § 5.11. Operating Areas Vehicles or equipment may only be used within the operating areas approved by the Local Service Provider. Access to protected areas, private property or restricted zones is prohibited unless expressly permitted. § 5.12. Return of Vehicles and Equipment Vehicles and equipment shall be returned: at the agreed location; at the agreed time; and together with all accessories provided. Late returns may result in additional rental charges where such charges have been disclosed before the booking. § 5.13. Cleaning Customers are expected to return rented vehicles and equipment in a reasonably clean condition, taking into account the normal nature of the booked activity. Additional cleaning costs may only be charged where the vehicle or equipment has been returned in an unusually dirty condition beyond normal use. § 5.14. Refusal of Vehicle Handover The Local Service Provider may refuse to hand over a vehicle where the Customer: fails to present the legally required documentation; refuses mandatory operational instructions; is unable to safely operate the vehicle; otherwise fails to satisfy the participation requirements applicable to the rental. Such refusal shall be based solely on legal or safety considerations. § 5.15 Return Inspection Upon return, the Local Service Provider may inspect the vehicle or equipment. Any newly identified damage may be documented using reasonable evidence, including photographs, videos or written inspection reports. The Customer shall be informed of any documented damage within a reasonable period. § 5.16. Additional Rental Conditions Certain vehicles or equipment may be subject to additional rental conditions issued by the respective Local Service Provider. Where such additional conditions apply, they shall be clearly communicated before completion of the booking and shall form part of the rental agreement. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 6 – LIABILITY AND INSURANCE § 6. General Liability Action Tours Global LLC shall be liable only in accordance with these Terms and the mandatory provisions of applicable law. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by law. § 6.1. Liability of Action Tours Global LLC Where Action Tours Global LLC acts as the organiser of an activity, the Company shall be responsible for the proper performance of its contractual obligations. Where Action Tours Global LLC acts solely as an intermediary or booking platform, responsibility for the operation and execution of the booked activity remains with the respective Local Service Provider. § 6.2. Liability of Local Service Providers Each Local Service Provider is independently responsible for: conducting the booked activity; maintaining vehicles and equipment; providing qualified guides or instructors where applicable; complying with local laws and regulations; implementing appropriate safety procedures. Action Tours Global LLC shall not be liable for operational decisions or omissions of an independent Local Service Provider except where liability is imposed by mandatory law. § 6.3. Limitation of Liability To the fullest extent permitted by applicable law, Action Tours Global LLC shall only be liable for direct losses resulting from its own intentional misconduct or gross negligence. The Company shall not be liable for indirect or consequential damages, including but not limited to: loss of profits; loss of business opportunities; loss of enjoyment; travel interruptions; accommodation costs; missed connections; or other consequential financial losses. This limitation does not apply where liability cannot legally be excluded. § 6.4. Customer Liability Customers are responsible for any damage they intentionally or negligently cause to: persons; vehicles; equipment; buildings; property; animals; or other participants, to the extent permitted by applicable law. § 6.5. Duty to Mitigate Loss Customers shall take reasonable steps to minimise any damage or loss arising during the performance of the booked activity. Failure to take reasonable measures may be taken into account when assessing any claim, where permitted by applicable law. § 6.6. Insurance Unless expressly stated otherwise, the booking price does not include: travel insurance; medical insurance; accident insurance; cancellation insurance; personal liability insurance. Customers are strongly encouraged to obtain appropriate insurance before travelling. Where a Local Service Provider includes insurance for a specific activity or rental vehicle, the scope, exclusions and limitations of that insurance shall be determined solely by the terms of the respective insurance policy or Local Service Provider. § 6.7. Medical Expenses Unless required by applicable law, Customers are solely responsible for all medical expenses arising from illness, injury or accidents occurring before, during or after the booked activity. § 6.8. Customer Claims If a Customer believes that a booked service has not been provided in accordance with the booking confirmation, the Customer should notify Action Tours Global LLC or the Local Service Provider as soon as reasonably possible. Prompt notification enables the issue to be investigated and, where appropriate, resolved without unnecessary delay. § 6.9. Time Limit for Complaints Unless a longer period is required by mandatory law, complaints relating to a booked activity should be submitted in writing within 30 days after the scheduled activity date. This provision does not affect any statutory limitation periods applicable under mandatory law. § 6.10. Customer Indemnification To the extent permitted by applicable law, Customers agree to indemnify and hold harmless Action Tours Global LLC, its directors, officers, employees and authorised representatives against claims arising directly from: breach of these Terms; unlawful conduct; misuse of rented vehicles or equipment; violation of applicable laws; or intentional damage caused by the Customer. § 6.11. Survival of Liability Provisions The provisions of this Part relating to liability, indemnification and limitation of liability shall survive the completion, cancellation or termination of the booking to the extent permitted by applicable law. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 7 – PRIVACY, MEDIA, INTELLECTUAL PROPERTY AND CUSTOMER CONTENT § 7. Privacy Action Tours Global LLC processes personal data solely for the purpose of providing its booking services, processing payments, communicating with Customers and complying with applicable legal obligations. Personal data shall be processed in accordance with the Company's Privacy Policy and applicable data protection laws. § 7.1 Customer Information Customers are responsible for ensuring that all personal information provided during the booking process is complete, accurate and kept up to date where necessary. Action Tours Global LLC shall not be responsible for losses resulting from incorrect or outdated information provided by the Customer. § 7.2. Electronic Records Customers acknowledge that booking confirmations, invoices, payment confirmations and other contractual records may be stored electronically. Electronic records may be retained for the period required by applicable law or for the legitimate business purposes of Action Tours Global LLC. § 7.3. Photography and Video Recording During certain activities, photographs or video recordings may be taken by Action Tours Global LLC or the Local Service Provider for operational, safety or promotional purposes. Where required by applicable law, the Customer's consent shall be obtained before photographs or videos are used for advertising or marketing purposes. Customers who do not wish to appear in promotional material should inform the guide or Local Service Provider before the activity begins. § 7.4. Customer Photography Customers may take photographs and videos for personal, non-commercial use during an activity unless: prohibited by law; restricted for safety reasons; restricted by the Local Service Provider; or prohibited in order to protect the privacy of other participants. The commercial use of photographs or videos taken during an activity requires prior written permission from the respective rights holder. § 7.5. Use of Drones The operation of drones during an activity is only permitted where: local law permits such operation; all required authorisations have been obtained; and the Local Service Provider has granted prior approval. Customers remain solely responsible for complying with all aviation and privacy regulations. § 7.6. Intellectual Property All content published by Action Tours Global LLC, including but not limited to: logos; trademarks; photographs; videos; graphics; texts; website design; software; marketing materials; is protected by applicable intellectual property laws. No content may be copied, reproduced, distributed or commercially exploited without prior written permission from Action Tours Global LLC or the respective rights holder. § 7.7. Customer Reviews Customers are welcome to submit honest reviews based on their personal experience. Reviews should: be truthful; relate to the booked activity; not contain unlawful, offensive or defamatory content; not infringe the rights of third parties. Action Tours Global LLC reserves the right to report or request the removal of reviews that violate applicable law or the terms of the respective review platform. § 7.8. Customer Content Where Customers upload photographs, videos, comments or other content through the Company's website or social media channels, they confirm that: they own the necessary rights to such content; or they have obtained all necessary permissions. Customers remain responsible for all content they submit. § 7.9. Marketing Communications Customers may receive service-related communications necessary for the performance of their booking. Marketing communications shall only be sent where permitted by applicable law or where the Customer has provided the required consent. Customers may withdraw their consent to receive marketing communications at any time using the unsubscribe method provided or by contacting Action Tours Global LLC. § 7.10. Website Use Customers shall not: attempt to gain unauthorized access to the Company's systems; interfere with the operation of the website; introduce malicious software; misuse the booking platform; use automated systems to extract website content without authorization. Action Tours Global LLC reserves all rights available under applicable law against unauthorized use of its systems. § 7.11. Reservation of Rights All rights not expressly granted to Customers under these Terms remain reserved by Action Tours Global LLC and the respective intellectual property owners. ACTION TOURS GLOBAL LLC GENERAL TERMS AND CONDITIONS (GTC) PART 8 – FINAL PROVISIONS § 8. Force Majeure Neither Action Tours Global LLC nor the Local Service Provider shall be liable for any delay, interruption or failure to perform contractual obligations where such performance is prevented or substantially hindered by events beyond their reasonable control. Force Majeure includes, but is not limited to: natural disasters; floods; earthquakes; hurricanes; severe storms; sandstorms; fires; pandemics; epidemics; war; terrorism; civil unrest; government actions; border closures; airport closures; transportation disruptions; strikes; cyberattacks; widespread power failures; or any other unforeseeable event beyond reasonable control. Where reasonably possible, Action Tours Global LLC shall make reasonable efforts to offer an alternative date, an alternative activity or another mutually acceptable solution. Nothing in this Section shall affect any mandatory consumer rights applicable under law. § 8.1. Changes to these Terms Action Tours Global LLC reserves the right to amend these Terms where necessary due to: legal requirements; operational changes; technological developments; business requirements. Any amendments shall apply only to bookings made after the revised Terms have been published. Confirmed bookings remain subject to the Terms accepted at the time of booking unless mandatory law requires otherwise. § 8.2. Invalid Provisions (Severability) If any provision of these Terms is found to be invalid, illegal or unenforceable under applicable law, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law. The invalid provision shall, where possible, be replaced by a valid provision that most closely reflects the original commercial intention. § 8.3. Waiver Failure by Action Tours Global LLC to enforce any provision of these Terms on one occasion shall not constitute a waiver of the right to enforce that provision or any other provision in the future. § 8.4. Entire Agreement These Terms, together with: the booking confirmation; the applicable activity description; any additional conditions communicated before booking; and the Privacy Policy, constitute the entire agreement between the Customer and Action Tours Global LLC relating to the booked service. § 8.5. Governing Law These Terms shall be governed by the laws of the State of Wyoming, United States of America, unless mandatory consumer protection laws applicable to the Customer require otherwise. § 8.6. Dispute Resolution Before commencing legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through direct communication and good-faith negotiations. Customers are encouraged to contact Action Tours Global LLC promptly so that concerns may be investigated and, where appropriate, resolved without unnecessary legal proceedings. Nothing in this Section limits any rights that cannot legally be waived under applicable law. § 8.7. Jurisdiction Unless mandatory law provides otherwise, the courts having jurisdiction in the State of Wyoming, United States of America, shall have exclusive jurisdiction over disputes arising from these Terms. Where mandatory consumer protection laws grant Customers the right to bring proceedings before another competent court, such rights shall remain unaffected. § 8.8. Language These General Terms and Conditions have been prepared in the English language. Translations into other languages are provided solely for the convenience of Customers. In the event of any inconsistency or conflict between a translated version and the English version, the English version shall prevail, unless mandatory law requires otherwise. § 8.9.
